A home buyer rebate, or commission rebate, is when a real estate agent or broker shares a portion of the fee they collect on a transaction with the buyer. According to the IRS, real estate commission rebates are “not taxable income.”

Eligible buyers shall disclose the rebate to all parties to the transaction, including to any lender financing the purchase of the property. If buyer is financing the purchase of the property, payment of the rebate (i) is subject to Buyer’s Lender approval of the acceptability and amount of the Rebate, and (ii) will be made via a credit to Buyer at closing on the closing statement or other transaction settlement statement.
